Emma Wiltshire

Emma is a Legal Director and Head of our Construction team.

Emma has 20 years experience specialising in all aspects of complex development and construction projects from procurement stage through to completed developments. Emma drafts and advises on all types of construction and engineering contracts (bespoke and industry standard forms, e.g. JCT, NEC, PFI/PPP/MIM), consultants’ appointments, collateral warranties, bonds and guarantees.

She has extensive experience of frameworks, including SEWSCAP, SWWRCF, DFE and Southern Construction Framework and an in-depth knowledge of two-stage tendering and call-off contracts. She also advises on risk management and dispute avoidance throughout the life-cycle of projects.

Emma was previously a Partner and head of non-contentious Construction at Clarke Willmott in Bristol, prior to spending 10 years as in-house counsel for Bouygues UK, where she was responsible for all projects bid and built by the Birmingham, Midlands, Wales and West region, which had an annual turnover of up to £250 million.

Recent work

Castle Park View 

Negotiating the Development Loan Agreement, Agreements for Lease, JCT Building Contract and ancillary documents for a £100 million, complex 26 storey high rise development project (Private Rented Sector and Affordable Housing) in Bristol. As well as remaining involved throughout the life cycle of the project advising with on-site issues and dispute avoidance whilst the project was built. The project was awarded the Building Project of the Year at the Constructing Excellence South West Awards 2023.

Cardiff University Innovation Campus

Advising on the £145 million project to build complex University research buildings and the award winning flagship social sciences hub (Sbarc building) from tender stage through to completed building, including negotiating an NEC Main Contract between the University and Main Contractor, drafting and negotiating project specific sub-contracts, and advising the Main Contractor on Compensation Events between them and the University and their supply chain.

Vantage Data Centre

Advising on a £84 million, joint venture agreement and single stage JCT contract to construct multiple new data centres in Newport, Wales.

Hinkley Point C 

Negotiating the Pre-Construction Services Agreement and NEC Option C (Target Cost) contract for HPC power station ancillary buildings. Drafting and negotiating project specific sub-contracts and consultants’ appointments and providing ongoing contractual and dispute avoidance advice throughout the course of the £50 million project.

Cardiff & Vale College 

Negotiating and advising on the Pre-Construction Services Agreement and bespoke PFI/PPP Development Agreement and Main Contract being procured though the Welsh Mutal Investment Model (MIM) funding model between the College and the Main Contractor. This will be the first College procured through the MIM model.

Bath University School of Management 

Advising on a £50 million project to build a University business school teaching facility with auditorium, including negotiating a GC Works Main contract, drafting a bespoke sub-contract and continuing to advise until completion of the project. This building won the Construction Excellence Digital Innovation Award (South West).

Pentre Awel

Advising on the £90 million regeneration project for a wellness centre in Llanelli, Wales. Negotiating the Pre-Construction Services Agreement and NEC Main Contract, drafting NEC sub-contract and providing extensive training on NEC contracts and programme management.
